THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.18834 of 2011 ORDER:
This writ petition is filed for the following substantive relief: "For the reasons stated in the accompanying affidavit, it is therefore, prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in issuing the individual Notification vide RC.B.No.231/2010-108-A, dated 22.02.2010 calling for applications from the general public for appointment as Fair Price Shop Dealer on permanent basis under O.C. category and the consequential proceedings of the 3rd respondent vide proceedings vide Rc.B.331/2010 dt: 20.04.2010 appointing the 5th respondent as Fair Price Shop Dealer of Shop No.108-A, Bapanadoddi Village, Hamlet of Kambalapadu Village, Krishnagiri Mandal, Kurnool District as illegal, arbitrary, unfair and contrary to the A.P. State Public Distribution System (Control) Order, 2008 and the guidelines for selection and appointment of Fair Price Shop Dealers issued in G.O.Ms.No.52 Consumer Affairs, Food and Civil Supplies (CS-1)
Department dt: 18.12.2008, and set aside the same and consequently direct the respondents to issue fresh notification for appointment of Fair Price Shop Dealer of Shop No.108-A, Bapanadoddi Village, Hamlet of Kambalapadu Village, Krishnagiri Mandal, Kurnool District by duly following the rule of reservation." After arguing the case, Sri Gangisetty Rajeswara Rao, learned counsel for the petitioner requested for the permission of the Court to unconditionally withdraw the Writ Petition.
The request of the learned counsel is accepted and the Writ Petition is accordingly dismissed as withdrawn.
As a sequel to dismissal of writ petition, WPMP.No.22750 of 2011 filed by the petitioner for interim relief is disposed of as infructuous. C.V.NAGARJUNA REDDY, J 4th JUNE, 2015.
