The grievance of the petitioners is that the revenue authorities are seeking to evict them from the subject land without following the due procedure laid down by law.

Perusal of the record reflects that notices were issued by the revenue authorities under the Land Encroachment Act, 1905, twice, but the proceedings did not culminate in any final orders. The pahanis placed on record indicate that the petitioners are in possession of the subject land.

That being so, the Writ Petition is disposed of directing the respondents not to interfere with the possession of the petitioners over the subject land except in accordance with the due procedure laid down by law.

Pending miscellaneous applications, if any, in this Writ Petition shall stand closed.
