ORDER:

Petitioner is the owner of the vehicle bearing No.TS 04 UA 1734 and

the said vehicle was seized by the third respondent on 21.01.2015, after conducting panchanama, on the ground of transporting PDS rice. The vehicle is presently in the custody of the fourth respondent. Petitioner has already made an application seeking release of the vehicle by approaching the second respondent, who is the competent authority, on 24.01.2015. Petitioner states that he is no way concerned with the said transportation and he was not aware that the rice transported is PDS rice, as the vehicle was borrowed by one Feroz and used for transportation. Petitioner states that he is willing to furnish appropriate bank guarantee and seeks release of the vehicle.

2. Since the petitioner's application for release was filed only on 24.01.2015, the Joint Collector/respondent No.2, is required to consider the same expeditiously.

3. In the circumstances, second respondent is directed to consider the petitioner's application for release of the vehicle taking into consideration all the facts and circumstances of the case and pass appropriate orders within a period of one week from the date of receipt of a copy of this order. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V.
