Heard.

The petitioner claims to be the owner of various extents of lands as mentioned in the writ petition and the land admeasuring Ac.19-31 gts., in Sy.Nos.151 and 183 situated at Yedula Village, Gopalpet Mandal, Mahaboobnagar District, is sought to be acquired by consent for Lift Irrigation Scheme under G.O.Ms.No.123, dated 30-07-2015 and third parties are making a claim for the very same land. He states that because he is physically handicapped, he was forced at knife point to compel to sign on withdrawal letter for settlement of dispute among him and the said third parties.

However, the petitioner complained to the 2nd respondent under his representation, dated 26-11-2015, and to the 4th respondent on 28-112015 bringing to their notice that the said third party claims require adjudication, as he has been cheated and it is not a free consent by him and, therefore, seeks that compensation amount be withheld till the result of the said dispute. Under G.O.Ms.No.123, dated 30-07-2015, a mechanism is provided under Clause 2 (VII) (d) where the Committee is empowered to hear any oral/written representations made in respect of any claim/objection by the interested persons or their authorized representatives.

Since the representations of the petitioner addressed to respondents 2 and 4, referred to above, are stated to be pending, in my view, it is appropriate for the Committee to consider the claim of the petitioner and pass appropriate orders before disbursement of any compensation to any party. The writ petition is, therefore, disposed of directing respondents 2 and 4 to place the said representations of the petitioner before the Committee, as aforesaid, and thereafter the Committee shall take appropriate decision thereon, as expeditiously as possible. No order as to costs.
