THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.10037 of 2008 ORDER:- This writ petition is filed for the following substantive relief: "to issue any writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of the respondents in not paying the salary of Rs.1500/- per month from 25.02.2004 till date as night watchman to the petitioner even though he is continuously working under the control of the respondents, as illegal and arbitrary, and consequently direct the respondents to pay the salary with all consequential benefits including arrears to the petitioner from 25.02.2004 to till date forthwith by considering the representations, dated 02.03.2007 and 08.01.2008 respectively." Heard the learned counsel for the petitioner as well as the learned counsel for the respondents.

The contention of the writ petitioner is that he is working as night watchman for protecting the properties of the temple on a consolidated pay of Rs.1500/- per month, but the salaries are not being paid to him by the respondents from 25.02.2004 till date. He has further submitted that he made representations to the 1st respondent on 02.03.2007 and 08.01.2008, and as a matter of fact, on the representation dated 08.01.2008, the Minister for Social Welfare, Government of Andhra Pradesh made an endorsement directing to settle the matter immediately, but no orders are passed and salaries are not being paid to the petitioner, even though he was continuously discharging duties as such.

In view of the facts and circumstances of the case, the 1st respondent is directed to pass appropriate orders on the representations of the petitioner, dated 02.03.2007 and 08.01.2008, in accordance with law, if they are still pending, within a period of 2 (two) months from the date of receipt of a copy of this order.

MSKJ,J WP No.10037 of 2008 The Writ Petition is accordingly disposed of. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
