THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2545 OF 2018 ORDER:

When the matter is taken up, written instructions, dated 05.02.2018, furnished by the Sub-Inspector of Police, M.R.Palli Police Station, Tirupathi Urban, Chittoor District are placed on record by the learned Government Pleader for Home (A.P.) appearing for the respondents. According to the said instructions, on the complaint made by petitioner No.1, police registered Crime No.247 of 2017 on 16.07.2017 for the alleged offences under Sections 427 and 447 read with 34 I.P.C. on the file of respondent No.3/M.R.Palli Police Station, Tirupathi, Chittoor District. It is also stated in the said instructions that notice under Section 91(1) Cr.P.C., dated 21.07.2017, was served on the complainant/petitioner No.2 asking him to furnish relevant documents pertaining to the land in Sy.No.13 situated at Avilala Village for the purpose of investigation.

It is further stated that the complainant received the said notice, but did not submit the relevant documents so far. It is also stated that on 02.02.2018, the investigating officer made a requisition to the Sub Registrar, Tirupathi Rural, requesting to furnish the actual ownership of the above said land and the report is awaited and that petitioner No.2/complainant, instead of cooperating with the investigating agency in providing the relevant documents, filed the present writ petition with baseless allegations.

completion of the investigation, appropriate report will be filed before the concerned Court.

The said instructions are placed on record.

The Writ Petition is, accordingly, disposed of, and the respondent police authorities are directed to complete the investigation as expeditiously as possible. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
