HON'BLE SRI JUSTICE CHALLA KODANDA RAM WIRT PETITION No.20267 OF 2015 ORDER:

The Writ Petition itself came to be filed aggrieved by the disconnection of power supply by the 2nd respondent Electricity Department. This Court while admitting the writ petition on 06.07.2015 directed to restore the power supply to the petitioner's house premises.

A counter affidavit along with vacate petition has been filed. In the vacate petition it has been stated by the 2nd respondent that the Commissioner of Greater Visakhapatnam Municipal Corporation had issued requisition to the Divisional Engineer (Operations) on 24.06.2015 that on account of the BRTS road widening it has become necessary to demolish the dilapidated house bearing Door No.57-1-22/1, 2 situated at Kancharapalem Main Road and as such the Electricity Service Connection No.053923 may be disconnected to enable the Department to remove the building. It is only on account of the request made from the Commissioner and in the overall public interest, especially to avoid electric short circuiting in the process of demolition causing damage to the public, disconnection has been effected.

However, pursuant to the direction of this Court power connection has been restored to the petitioner. Learned counsel for the petitioner further submits that the petitioner had questioned the requisition by the G.V.M.C. as motivated and this Court disposed of the Writ Petition No.20267 of 2015 by its order dated 06.07.2015, giving liberty to the petitioner to work out the remedies.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, the miscellaneous petitions pending, if any, shall also stand closed.
