This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who was arrayed as accused No.2 in P.O.R.No.22-01/2022-2023, before Forest Range Officer, Shamshabad, Gaganpahad, Rajendranagar, Ranga Reddy, registered for the offences punishable under Sections 9, 2 (16), 39, 49, 50, 51, 55 and 57 of the Wild Life (Protection) Act, 1972 2.

Heard Sri Syed Ahmed Ali, learned counsel for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

The case of the prosecution is that The Forest Range Officer, Shamshabad received information that some persons are selling meat of Deer, they immediately conducted inspection and seized 15 Kgs of Deer Meat, Deer Head, Deer Legs, Skin and arrested Accused No.1, who confessed that he purchased the Deer from the petitioner herein. The petitioner herein is arrayed as accused No.2.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him; that the alleged offences are punishable with imprisonment for a period of below seven years and without considering the same, police have not issued notice under Section 35 (3) of BNSS 2023 and that the learned trial Court also dismissed the application; that the petitioner is ready to cooperate with the investigation of the case and requested this Court to grant Anticipatory Bail to the petitioner-accused No.2. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and would submit that the offences alleged against the petitioner are severe in nature, which cause hindrance to environment.

The petitioner is the prime accused. Therefore, custodial

interrogation of the petitioner is required in this case and therefore, requested this Court to dismiss the Criminal Petition. 6.

Considering the submissions made by both the parties and perusal of the material on record, the petitioner herein is arrayed as accused No.2 in the aforesaid crime. Basing on the confessional statement of accused No.1, he received Deer from the petitioner. As seen from the record, the offences alleged against the petitioner are punishable below 7 years. The investigation is pending to the extent of receiving FSL report. Therefore, this Court is inclined to grant Anticipatory Bail to the petitioner subject to following conditions:

(i) The petitioner shall surrender before the Forest Range Officer, Shamshabad, Gaganpahad, Rajendernagar, Ranga Reddy District, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each. (ii) The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

(iii) The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the

filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
