HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.261 of 2014 ORDER:

This petition is filed to withdraw O.P.No.14 of 2014 from the file of Additional Family Court, City Civil Court, Hyderabad and transfer the same to Senior Civil Judge, Mancherial, Adilabad District.

2. Petitioner herein is wife and she filed her affidavit in support of the petition, according to which, her marriage with respondent was performed on 16.05.2010 at Hyderabad and when she was carrying pregnancy she was necked out from the house and due to the mental torture there was miscarriage and her health condition is deteriorated.

It is further contended that respondent/husband filed O.P.No.14 of 2014 only to harass her and that she is residing at Mancherial with her parents and she is a house wife and she has no income of her own and it is difficult for her to defend O.P.No.14 of 2014 at Hyderabad by travelling from Mancherial, therefore, she prayed for transfer of O.P.No.14 of 2014 from Additional Family Court, City Civil Court, Hyderabad to Senior Civil Judge, Mancherial.

3. Advocate for respondent represented that she has given up her vakalat and no objection certificate is given long back and she has no instructions.

4. No one appeared on behalf of respondent/husband.

5. Heard advocate for petitioner.

6. I have perused the material papers including affidavit filed in support of the transfer O.P. The affidavit averments of petitioner/wife remained unchallenged as the respondent/husband failed to file any counter.

7. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.14 of 2014 is withdrawn from Additional Family Court, City Civil Court, Hyderabad and transferred to Senior civil Judge, Mancherial, Adilabad District for disposal in accordance with law.

8. Accordingly, this Transfer Miscellaneous Petition is allowed. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
