HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2992 OF 2019 O R D E R:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring the action of the 3rd respondent in issuing the impugned Notice, dt.08.02.2019 whereby calling for the Explanation from the petitioner for cancellation of the Building Permission already granted in his favour vide proceedings No.GP/RKT/121/18, dt:29.07.2018 for the House bearing No.4-45/1 situated at Sy.No.102, Rekurthi Village, Kothapalli Mandal, Karimnagar District as illegal, arbitrary and unconstitutional and to set aside the same and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case."

The grievance of the petitioner is essentially with a show cause notice. It is not the case of Sri C.Hari Preeth, learned counsel for the petitioner, that the Panchayat Secretary, Rekurthy Gram Panchayat, lacks jurisdiction to issue such a show cause notice. If that is so, it is for the petitioner to respond to the show cause notice and make good his case with proper documentation. No cause is made out for this Court to interfere with the impugned show cause notice at this stage.

The Writ Petition is devoid of merit and is accordingly dismissed.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
