HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 790 OF 2022 O R D E R:
This Criminal Petition under Section 438 Cr.P.C. is filed by the petitioner - Accused seeking bail in the event of her arrest in connection with Crime No. 318 of 2021 on the file of Armoor Police Station registered for the offence punishable under Section 306 IPC.

The case of the prosecution is that on 20.11.2021, the de facto complainant submitted a report stating that his cousin namely Maasuri Sravathi (deceased) with an intent to construct a new house at their native place, entered into an agreement with builder Sri Naresh for Rs.23 lakhs and as per the agreement, the said Naresh took advance but did not commence the work. While so, on 20.11.2021, at about 13.00 hours, the deceased along with her husband including the complainant and his wife went to the house of Naresh with a request to repay the amount and enquired about him but he was not present. On that, thinking that he will never return the amount, the deceased in frustration poured petrol on her and set herself ablaze and sustained burn injuries and succumbed to the same while undergoing treatment.

Learned counsel for the petitioner Sri T. Sujan Kumar Reddy submits that th petitioner's husband is arrayed as Accused No.1 for the offence under Section 306 IPC. and this Court in Criminal Petition No. 354 of 2022 has already granted
pre-arrest bail to him. He submits that on the ground that the petitioner also harassed the deceased, she was being continuously called to the police station. He submits that the petitioner apprehends arrest, hence, her case may also be considered for grant of pre-arrest bail.

On the other hand, learned Assistant Public Prosecutor submits that subsequent investigation reveals involvement of the petitioner and she was arrayed as Accused No.2 and investigation is pending.

Taking into consideration the fact that already Accused No.1 was granted pre-arrest bail by this Court in Criminal Petition No. 354 of 2022, this Court deems it appropriate to grant pre-arrest bail to her.

Accordingly, this Criminal Petition is allowed. Petitioner - Accused shall surrender before the Station House Officer, Armoor Police Station, in connection with Crime No. 318 of 2021 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, she shall be released on bail. It is made clear that no further extension of time will be granted. The petitioner shall cooperate with the investigation.
