HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3023 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the inaction of the 4th respondent in not issuing new pattadar pass books in survey No.26/6 (old Sy.No.26) admeasuring Acres.5.00 guntas situated at Tatlawai Revenue Village Raikal Mandal, Jagtial District, in spite of the representation dated 24.11.2018 as being illegal, arbitrary, contrary to the provisions of the Rights in Land and Pattadar Pass Books Act, 1971, and consequently direct the 4th respondent to issue new pattadar pass books for land in Sy.No.26/6 (old Sy.No.26) admeasurng Acres 5 00 guntas situated at Tatlawai Revenue Village, Raikal Mandal, Jagtial District, and extend the benefits of Rythu Bandhu and Rythu Bheema and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioner was issued a pattadar passbook under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, in relation to the subject land. That being so, it is not open to the Tahsildar, Raikal Mandal, Jagtial District, to remain inactive upon the petitioner's representation made as long back as on 24.11.2018 for issuance of a new pattadar passbook.

The Writ Petition is accordingly disposed of directing the Tahsildar, Raikal Mandal, Jagtial District, to take appropriate action upon the petitioner's representation dated 24.11.2018 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
