HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5116 OF 2015 ORDER:

The petitioner, who is A1 in C.C.No.308 of 2013 on the file of the XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, filed this petition under Section 438 Cr.P.C. seeking anticipatory bail. The petitioner and three others were alleged to have committed the offence punishable under Sections 498-A, 406 IPC and Sections 4 & 6 of the Dowry Prohibition Act.

It is stated that since the petitioner is in abroad, he could not appear either before the police or the Court below and the police filed the charge sheet in the above C.C. by showing the petitioner absconding and hence, the Court below issued NBWs against the petitioner.

Considering the above facts and circumstances of the case, the petitioner is directed to appear before the Court below and file an application to recall NBWs pending. On such application being filed, the Court below is directed to recall NBWs issued against the petitioner on the same day on condition of the petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the Court below, and to direct him to appear before the Court below regularly on every date of adjournment. With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. _________________ Justice Raja Elango Dated: 17.6.2015 Nn.
