The present writ petition is filed to declare the action of the respondents, more particularly 4th respondent-Station House Officer, Gandhinagar Police Station, Hyderabad, in not registering a crime having received the complaint on 25.01.2020, as being illegal, arbitrary and contrary to the provisions of the Criminal Procedure Code.

Heard Sri Nagula Srinivas Yadav, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home, on written instructions dated 13.02.2020, a copy of which is placed on the record of this Court, submits that the alleged complaint made by the petitioner on 25.01.2020 has not been received at all. It is stated that the respondent police authorities have verified the station records and found that no such complaint having been received. It is also stated that the petitioner instead of approaching the 4th respondent along with the complaint, filed present the writ petition with baseless allegations stating that the 4th respondent is not registering the crime having received the complaint. Having regard to fact stated in the written statement that no such complaint is received by the authorities, it is open for the petitioner to approach the respondent authorities by making a complaint of alleged offences, if any. Upon the petitioner approaching the respondent authorities and making a complaint,

the authorities shall take note and deal with the same in accordance with law.

Subject to the above observation and direction, the writ petition is closed. No order as to costs. Pending miscellaneous petitions, if any, pending in this writ petition shall stand closed, in the light of this final order.
