THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3355 OF 2018 ORDER:

The petitioners state that they have been residing in Door Nos.1-45 to 1-49 by paying electricity charges, house taxes etc. While so, the fifth respondent constructed a wall obstructing the road and the same is subject matter of W.P.No.1981 of 2017. The petitioners have been using the said property for the purpose of school. The petitioners state that they submitted an application on 30.01.2017 for conducting survey and fixing the boundaries to the road, which is supposed to be having 20 feet, wherein the compound wall was constructed by the Sarpanch and when no action was taken on their application, the present writ petition is filed. Though time was granted to the learned Government Pleader on 05.02.2018 for getting instructions, no instructions were received by him.

In the circumstances, the writ petition is disposed of directing the second respondent to consider the application of the petitioners, dated 30.01.2017 and take necessary action in accordance with law as per the Government Circulars issued from time to time within a period of four weeks from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
