THE HON'BLE SRI JUSTICE SANJAY KUMAR Contempt Case No.976 of 2014 ORDER:

This contempt case was filed alleging disobedience to the interim order dated 10.04.2013 passed by this Court in W.P.M.P.No.9772 of 2013 in W.P.No.7805 of 2013. By the said order, this Court directed the respondents, the authorities of the Forest Department of the State, not to interfere with the petitioners' possession in respect of the land covered by the order dated 30.12.1976 passed by the Forest Settlement Officer, Warangal. Thereafter, the officials of the Police Department were also impleaded by name as respondents 3 to 7 as per the order dated 02.04.2015 passed by this Court in Application No.105 of 2015 filed in this contempt case.

Notices having been served upon all the respondents, counters were also filed by them.

Perusal of the pleadings demonstrates that the police authorities claim that action was taken against the persons who are not parties to the writ petition upon the complaint lodged by the Forest Department officials.

Though Sri Nageswara Rao Turaga, learned counsel for the petitioners, would contend that those persons were also related to the petitioners in the writ petition, the order of this Court was specific as to its applicability only to the possession of the petitioners in the writ petition. Therefore, the protection granted by this Court to the petitioners cannot be extended to those claiming through them. In the event there is any interference by the Forest Department officials with the possession of the petitioners over the subject land, it would give rise to a cause in terms of disobedience to the order passed by this Court.

The contempt case is therefore dismissed. No order as to costs. ____________________
