HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7901 of 2017 ORDER:
Heard learned counsel for the petitioner of Crime No.61 of 2017 of Rapur Police Station, SPSR Nellore District, registered for the offence punishable under Section 34(A) of the A.P.Excise Act and learned Public Prosecutor representing the State and perused the grounds urged in the quash petition and the mediators panchanama.
Though it is the contention that even from the so called disclosure statement of A1 with whom the so called liquor bottles were seized what he simply stated he purchased from the shop of A2 that makes no offence at all. It is the matter to be investigated into by the police and there is nothing to admit the petition. Accordingly, the Criminal Petition is disposed of. All the available defences are left open. However, the Police are directed to complete the investigation and file final report, within a period of two months from today and pending investigation, the petitioner/ A2 shall not be arrested. This order will not prevent the Police to secure the petitioner/ A2 for the purpose of investigation, as and when required.
