HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.12338 of 2016 ORDER:

The petitioner filed this Criminal Petition under Sections 482 Cr.P.C. praying to pass orders directing the S.H.O., Prohibition and Excise Station, Yellandu, Khammam District to release the Bajaj Pulsor Motorcycle bearing Registration No.TS 03 EH 2439 seized in Crime No.100 of 2016 by permitting the petitioner to furnish third party surety before the Court of Judicial First Class Magistrate at Yellandu.

Heard and perused the records.

Having regard to the facts and circumstances of the case, the Criminal Petition is disposed of directing the petitioner to file application before the Deputy Commissioner of Prohibition & Excise, Khammam, seeking release of vehicle and on filing of such application, the same shall be disposed of within a period of one week from the date of filing.
