THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.P.No.5433 of 2016
ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in C.C.No.48 of 2015 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, for the offences punishable under Sections 420, 468, 471, 406, 506 IPC, against them.
2. It is alleged in the charge sheet that the petitioner/accused offered to sell the land in an extent of Ac.11.00 for a sum of Rs.92 Crores, and accordingly, the complainant entered into an agreement and paid a sum of Rs.25 lakhs to the accused promising to pay the remaining amount on or before 09.09.2007, thereafter, the complainant also paid a sum of Rs.5 lakhs to the accused towards part payment.
After due verification, the complainant came to know that the said lands are Government lands and the accused created a forged document in the name of one Hyderunnisa Begum and in spite of several demands, the accused did not return the said amount, thereby cheated the complainant. Based on the complaint, a case in Cr.No.167 of 2013 u/s.420, 468, 471, 406 and 506 IPC was registered against the accused.
3. Heard and perused the material on record.
4. In view of the serious allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. However, the presence of the petitioner/accused before the trial Court is dispensed with except on the dates whenever his presence is insisted by the trial Court and he shall be represented by his counsel.
