ORDER

This writ petition is filed seeking to issue a Writ of Mandamus directing the respondents to assign work to the petitioner as Paid Secretary either at PACS Boregaon or any other place; to pay the monthly salary of the petitioner from June, 1999 to till date; to provide all other consequential service benefits and monetary benefits to the petitioner; and to revise the pay fixation of the petitioner from 1991; and declaring the action of the respondents in not paying salary from June, 1999, without any reason and notice, as arbitrary and illegal.

Heard Sri S.Chandrasekhar, learned counsel appearing for the petitioner and learned Government Pleader for Co-Operation appearing for the respondents.

When the matter is taken up for hearing, it is noticed that the writ petition against the 1st respondent was dismissed for default as per the Court order dated 23.06.2011 and thereafter, no steps have been taken to restore the writ petition against the 1st respondent.

The relief sought for in this writ petition is against the 1st respondent. In the absence of the 1st respondent, no relief can be granted to the petitioner. Apart from that the petitioner is also retired from service on attaining the age of superannuation.

Hence, the cause in the writ petition does not survive for adjudication.
