THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2579 OF 2018 ORDER:
This writ petition is filed challenging the action of the respondents in not conducting survey of the total extent of the land in Survey No.235 of Kamanahalli Village, Haleharvi Mandal, Kurnool District and fix the boundaries to the petitioner's land to an extent of Acs.4.12 cents.
When the matter is taken up for consideration, learned Government Pleader produced before this Court the written instructions submitted by the third respondent stating that pursuant to the application of the petitioner, the Inspector of Survey was deputed along with the Village Revenue Officer to survey the land and fix the boundaries. The Inspector of Survey submitted a report stating that the petitioner is having only Acs.2.08 cents and fixed the boundaries. Survey No.235 was sub-divided on 21.02.1979 and pattadar pass books were issued to various persons, who are in enjoyment of respective extents of lands. But it appears that the petitioner got registered the land more than his enjoyment.
The Inspector of Survey submitted a report stating that the petitioner is not accepting for the extent and in those circumstances, the help of the District Surveyor was sought. The District Surveyor has surveyed the land and fixed the boundaries and as per the enjoyment, they decided only Acs.2.08 cents in the name of the petitioner. Since no communication was received by the petitioner with regard to the survey of the land, the third respondent is directed to pass appropriate orders pursuant to the survey and communicate the same to the petitioner.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 09.02.2018 pln
