THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5177 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-1 to A-3 in P.R.C.No.11 of 2016 on the file of Judicial Magistrate of First Class, Dhone, Kurnool District arising out of Crime No.197 of 2015 of Peapully Police Station, registered for the offences punishable under Sections 498 A, 307, 313, 420 read with Section 34 IPC.

Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioners, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

In any event, considering the facts and circumstances of the case, the presence of the petitioners-2 and 3/A-2 and A-3 before the trial Court is dispensed with except on the dates when their presence is specifically required for the purpose of framing of charges, examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment and the petitioners shall be properly represented by their counsel. However, the first petitioner/A-1 shall present before the Court on all the dates of hearing on his behalf and on behalf of all the accused.

With the above observation, this criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
