THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.1440 of 2025 ORDER:
The present Criminal Petition is filed, seeking the Court to enlarge the petitioner, on bail, who is arrayed as accused No.1 in Crime No.01 of 2025 of L.B.Nagar Police Station, Rachakonda Commissionerate. The offences alleged against the petitioner are under Sections 80 (2) r/w.3 (5) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the complainant who is the mother of deceased lodged a complaint before the police on 02.01.2025 stating that her daughter committed suicide due to harassment of the petitioner herein for want of additional dowry. The date of marriage of the deceased and petitioner is 12.12.2024 and within two months of the marriage the deceased committed suicide. As such, requested the police to take necessary action against the accused. 3.
Heard Sri Ch.Raj Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the marriage of petitioner with the deceased was performed on 12.12.2024 and before marriage, they both were in live-in relationship from the year 2021 and the deceased gave birth to twins and thereafter they got married. As there was no dowry at the time of marriage, the question of demanding additional dowry does not arise. The petitioner is in jail from 03.01.2025 and material part of investigation is completed. As such, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that within two months of the marriage the deceased committed suicide and the death was in the house of petitioner. The allegations against the petitioner are serious in nature and hence prayed to dismiss this application.

Considering the submissions made by both the counsel and the material on record, the petitioner herein is in jail from 03.01.2025 and as seen from the record, 16 witnesses are already examined. Considering the period of incarceration of
petitioner in jail, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of II Additional Junior Civil Judge-cum-II Metropolitan Magistrate at L.B.Nagar, Ranga Reddy District.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 482(2) of BNSS (previously known as Section 437 (3) of Cr.P.C.) 7.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
