HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.2602 of 2018 ORDER: Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, petitioner challenged the order dated 22.09.2017 passed in O.A.No.2562 of 2017 by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby her application, filed under Section 19 of the Administrative Tribunals Act, 1985, to declare the action of the respondents in deferring her promotion to the post of Special Grade Municipal Commissioner on regular or ad-hoc or temporary, referring to disciplinary proceedings, was dismissed.

Learned Counsel appearing for the petitioner submits that the petitioner's case may be considered in terms of G.O.Ms.No.257 dated 10.06.1999.

Learned Government Pleader for Services (AP) submits that, since the petitioner's case falls under G.O.Ms.No.257 dated 10.06.1999, therefore, her case will be considered in terms of G.O.Ms.No.257 dated 10.06.1999.

In view of the statement made by the learned Government Pleader for Services (AP), we hereby direct the respondents to consider the case of the petitioner in terms of G.O.Ms.No.257 dated 10.06.1999.

The Writ Petition is, accordingly, allowed setting aside the order dated 22.09.2017 passed in O.A.No.2562 of 2017 by the Andhra Pradesh Administrative Tribunal, Hyderabad.
