HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3211 of 2019 ORDER:

The grievance of the petitioner is that the Tahsildar, Miryalaguda Mandal, Nalgonda District, is not issuing her an e-pattadar pass book and a title deed in relation to her lands admeasuring Acs.24.21 guntas, comprising Acs.3.27 guntas in Sy.No.217; Acs.4.38 guntas in Sy.No.218; Acs.4.14 guntas in Sy.No.219; Acs.8.30 guntas in Sy.No.366; and Acs.2.32 guntas in Sy.No.367 of Chinthapally Village, Miryalaguda Mandal, Nalgonda District Perusal of the record reflects that the petitioner was issued a pattadar pass book and a title deed in relation to the subject lands under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. She made an application to the Tahsildar, Miryalaguda Mandal, Nalgonda District, on 12.01.

2019 seeking issuance of an e-pattadar pass book and a title deed and the endorsement made therein evidences receipt of the said application by the Tahsildar's office on the very same day. Though the Learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that steps are being taken for cancellation of the existing pattadar passbook and title deed issued to the petitioner, this Court is of the opinion that when the Tahsildar received an application from the petitioner, he cannot remain inert upon the same. If grounds are made out for rejection of the request made by the petitioner, it is for the Tahsildar to pass a reasoned order and communicate the same to the petitioner.

SK, J WP.No.3211 of 2019 Dt:19.02.2019 The Writ Petition is accordingly disposed of directing the Tahsildar, Miryalaguda Mandal, Nalgonda District, to take appropriate action upon the petitioner's application dated 12.01.2019 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order. Pending Miscellaneous Petitions, if any, shall also stand closed in the light of this order. No order as to costs. ________________________ JUSTICE SANJAY KUMAR 19th February, 2019 dr
