HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10113 of 2015 ORDER:
This petition is filed by the petitioner-A3 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.385 of 2015 of Nallapadu Police Station, Guntur District, registered for the offence punishable under Sections 120-B, 419, 420, 465, 467, 468, 471 and 506 r/w 34 IPC.
Heard and perused the material available on record. It is alleged that the de facto complainant is the owner of an extent of 422 sq. yards of site situated at Chuttugunta centre and that the said property was purchased by her father-in-law and after his death, she became absolute owner of the said property. But A1 and A2 created a document as if the mother-in-law of the de facto complainant executed sale deed in the year 2002 and that the petitioner is the attestor of the said document.
Learned Public Prosecutor submitted that the bail application filed by A2, who stands on the same footing as that of the petitioner, was dismissed by this Court. Considering the facts and circumstances of the case and the above submission made by the learned Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
