THE HON'BLE SRI JUSTICE P. NAVEEN RAO ORDER:

According to the petitioner, her husband was killed by extremists on 5.8.1997 while working as RMP, Gunjedu village. F.I.R.No.21 of 1997 was registered on 5.8.1997 under Sections 148, 302 read with Section 149 IPC and Section 25(1)(a) of Indian Arms Act.

Taking advantage of the scheme formulated by the Government to award compensation to the family members of persons who killed by extremists, petitioner submitted an application on 24.12.2018, requesting the respondents for grant of ex-gratia. Alleging inaction on the part of respondents, this writ petition is filed. 3.

On instructions, the learned Government Pleader submits that the respondents have not received any claim application made by the petitioner and therefore the same could not be processed. It can be seen from the material placed on record in the writ petition, the petitioner made applications to respondents 2 and 3 on 24.12.2018, which were acknowledged by the office of Collector. Therefore, it cannot be said that the petitioner has not made application. However, the learned Government Pleader sought to contend that after 24.12.2018, the District Level Scrutiny Committee meetings are not held. Not holding committee meetings cannot be attributable to the petitioner.

Therefore, the writ petition is disposed of, directing the Respondents 2 and 3 to process the application of the petitioner dated 24.12.2018 and if the petitioner is found eligible to receive ex-gratia amount, the same shall be paid to the petitioner as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
