First petitioner was appointed as Light Vehicle Driver on 1.6.1989, completed 12 years of service on 31.5.2001 and completed 20 years of service on 31.5.2009. The 2nd, 3rd and 4th petitioners were appointed as Light Vehicle Drivers on 1.4.1990, completed 12 years of service on 31.3.2002 and completed 20 years of service on 31.3.2010. The 2nd petitioner retired on attaining the age of superannuation on 31.8.2015. With a view to relieve stagnation scheme of Special Grades was introduced in the Revised Pay Scales 1989, to give relief to the employees who have completed 12 years of service in the same category. In the revision of Pay Scales of 2009, the Scheme was further modified by making provision for second advancement on completion of 20 years of service in the same category. A Circular No. PD-4/2011 dated 12.1.

2011 was issued specifying the special grades on completion of 12 years of service. As per the said Scheme an employee who completes 20 years of service in the same category of post and enjoying the 12 years stagnation grade shall be placed on to the corresponding scale as indicated in the Annexure. The petitioners are entitled to the said Special Grades in the category of Light Vehicle Drivers. Petitioners submitted representations dated 1.6.2015, 7.9.

PNR,J W.P.NO. 13223 OF 2017 representation dated 10.11.2015 to the 2nd respondent requesting to sanction Special Grade to them. The 2nd respondent Office has sought clarification from the 3rd respondent vide letter dated 13.11.2015. Though petitioners personally approached the respondents several times and represented grievance through Employees Union, no action is taken.

Alleging inaction in attending to their grievance, this Writ Petition is filed.

Since representations dated 1.6.2015, 7.9.2015 and 10.11.2015 are yet to be responded, the Writ Petition is disposed of directing Regional Manager, 2nd respondent to examine the grievance ventilated by petitioners in their representations referred to above, and to pass reasoned orders, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions, pending if any, shall stand closed.
