HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3036 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 is not proceeding with the survey/demarcation and sub division of the land in survey No.91/RU admeasugin Acs.5.14 gts situated at Nyamathapur village, Kadtal Mandal, Ranga Reddy District as illegal and violation of principles of natural justice and the provisions of AP Rights in land and pattadar Pass Books Act, 1989, and to direct the respondent No.3 to conduct the survey and fix the boundaries by sub division of survey No 91/RU admeasuring Acs.5.

14 gts situated at Nyamathapur village, Kadtal Mandal, Ranga Reddy District, basing on the application dated 20.02.2018, on the ground that a survey was requested for a part of the total survey number and the field measurements were not available, as arbitrary and illegal and also violative of Articles 14 and 16 of the Constitution of India and consequently direct the respondents to consider the application dt 20.02.2018 for conducting the survey and demarcating and fixing the boundaries by sub division of the subject land and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case." Perusal of the record reflects that the petitioner submitted a F-line petition on 20.02.2018 seeking a survey of the subject land and fixing of boundaries thereon.

Having received such an application, it is not open to the revenue authorities to remain somnolent.

The Writ Petition is accordingly disposed of directing the respondents to take appropriate action upon the petitioner's F-line petition dated 20.02.2018 for conducting a survey of the subject land and fixing of boundaries thereon. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order. Pending Miscellaneous Petitions, if any, shall stand disposed of in the light of this final order. No order as to costs. ________________________ JUSTICE SANJAY KUMAR 15th February, 2019
