None appears for the petitioner.

The learned counsel appearing on behalf of respondents 1 and 2 placing reliance upon an unreported Judgment of the Supreme Court in ULTRA TECH CEMENT LIMITED v. RAKESH KUMAR SINGH AND ANOTHER (Criminal Appeal No.717 of 2015, dated 24-04-2015), would submit that respondent No.1, who is the complainant in C.C.No.2827 of 2012, has already filed his chief-affidavit before the Court concerned and the criminal case need not be transferred as prayed for by the petitioner.

In that view of the matter and in view of the principle enunciated by the Supreme Court in the case cited supra, the Transfer Criminal Petition is dismissed. __________________________ NOOTY RAMAMOHANA RAO, J.
