THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.31231 of 2015 ORDER:

The grievance of the petitioner is that the Circle Inspector of Police, Crime Investigation Department, Kurnool, the third respondent, was not taking any action upon his complaint dated 10.08.2015. By way of the said complaint, the petitioner sought investigation in Crime No.141 of 2013 on the file of III Town Police Station, Anantapur, and Crime No.237 of 2013 on the file of I Town Police Station, Anantapur, to be completed and necessary consequential action to be taken thereafter.

The Inspector of Police, CID Regional Office, Kurnool, filed a counter-affidavit stating that Crime No.141 of 2013 was registered under Section 420 IPC on the file of III Town Police Station, Anantapur, while Crime No.237 of 2013 was registered under Section 420 I.P.C. on the file of I Town Police Station, Anantapur, upon the complaints made by the petitioner's wife. He further stated that after due investigation, both the cases have been transferred to the Additional Director General of Police, CID, Andhra Pradesh, who in turn entrusted them to the third respondent for further investigation. The details of the investigation till date were set out and the Inspector of Police concluded by stating that after obtaining the reports from the respective departments, necessary action would be taken as per law and appropriate reports would be filed in relation to both the crimes before the competent courts.

In the light of the afore-stated stand of the police authorities, the grievance of the petitioner as to the alleged inaction on the part of the police authorities is shown to be without basis.

The writ petition is accordingly closed. The third respondent shall complete the investigation in the subject crimes expeditiously and take appropriation action in the matter thereafter in accordance with law. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
