THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2608 OF 2018 ORDER:

The alleged inaction on the part of respondent No.2 - The Station House Officer, Yadagirigutta Police Station, Yadadri Bhonagiri District in completing the investigation and filing charge sheet against respondent Nos.3 to 6 herein in Crime No.301 of 2016 is under challenge in the present writ petition. 2.

When the matter is taken up, written instructions, dated 30.01.2018, furnished by the Sub-Inspector of Police, Yadagirigutta Police Station, Yadadri Bhonagiri District are placed on record by the learned Government Pleader for Home (TG) appearing for respondent Nos.1 and 2. The said instructions read as under:- "It is pertinent to submit that the averments made in the affidavit are the subject matter of the investigation in Cr.No.301/2016 for which a detailed investigation is under progress. The investigation is pending for want of examination of some more witnesses and to collect material evidence to establish the offence u/sec.420 and 506 IPC against the accused.

While the investigation is under progress, the accused/unofficial respondents approached this Hon'ble Court and filed W.P.No.5890 of 2017 praying the Hon'ble Court to direct the respondents to follow the procedure U/sec.41(1)(b) and 41-A Cr.P.C. and also not to arrest them. This Hon'ble Court by order dated 21.2.2017 disposed of the writ petition directing the respondent police shall follow due process of law while investigation into the case.

To complete the full-fledged investigation into the case, it requires some more time to the investigating agency."

Having regard to the above instructions furnished by the Sub-Inspector of Police, Yadagirigutta Police Station, Yadadri Bhonagiri District and keeping in view the nature of controversy, this Court deems it appropriate to dispose of the present writ petition, with a direction to the respondent police authorities to complete the investigation as expeditiously as possible. 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
