ORDER:
This Writ Petition is filed for a Mandamus to set aside proceedings, vide F.No.861/CC/WGL/2015/ZIII/Supply, dated 19.12.2015, of respondent No.2, whereby it has constituted respondent No.5 for Masjid-eAlwan-e-Shahi, Subedari, Hanamkonda Mandal, Warangal District.
After hearing Mr. G.L.Narasimha Rao, learned counsel for the petitioner, and upon perusing the record, I am of the opinion that as the dispute raised by the petitioner pertains to wakf, he has an alternative remedy of invoking the jurisdiction of the Wakf Tribunal under Section-83(2) of the Wakf Act, 1995.
In view of the availability of above-mentioned
effective alternative remedy to the petitioner, this Court is not inclined to entertain this Writ Petition for adjudication on merits.
The Writ Petition is, accordingly, dismissed with liberty to the petitioner to avail the remedy as observed hereinbefore.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.248 of 2016 shall stand dismissed as infructuous.
