HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21841 OF 2016 ORDER:

This writ petition is filed questioning the endorsement in File Nos.B/187/2015, B/188/2015, B/189/2015, B/190/2015, B/191/2015, B/192/2015 and B/193/2015 dated 05.09.2015 issued by the 3rd respondent rejecting the application made by the petitioner for mutation. Learned counsel for the petitioner submits that the said endorsement was issued without any notice to the petitioner and the same is in violation of Section 5(3) of Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act'). Learned Assistant Government Pleader for Revenue submits that the subject lands are classified as Government land and was assigned to various landless poor persons which were resumed under Andhra Pradesh Assigned (POT) Lands Act, 1977.

In view of the above, without expressing any opinion on merits, the impugned endorsement is set aside only on a short ground of violation of Section 5(3) of the Act and for violation of principles of natural justice. However, it is open for the petitioner to raise all the pleas before the 3rd respondent and the 3rd respondent is directed to consider the same, while disposing of the application filed by the petitioner. With the above direction, this writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
