T. Shanker v. The Government Of Telangana,
HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.17438 of 2014
ORDER
This writ petition is filed seeking to declare the action of the 3rd respondent in summoning the petitioner to the II Town Police Station, Khammam, at the instance of the 4th respondent without there being any complaint, as arbitrary and illegal. The petitioner states that the 4th respondent approached him for financial help of Rs.4,00,000/- for his family necessities by proposing to pledge his house No.11-6-217, Nehru Nagar, Mekala Banda, Khammam, and agreed to repay the same within six months. The petitioner agreed for the same and advanced the said amount. In spite of his repeated requests, the 4th respondent did not repay the same. While so, in the month of January, 2014, on receiving a phone call from the 3rd respondent, he went to the police station, where the 4th respondent demanded him to return his property documents.
Thereupon, the petitioner brought to the notice of the 3rd respondent with regard to the alleged transaction that took place between him and the 4th respondent. However, the 3rd respondent is frequently calling the petitioner to the police station without there being any complaint and threatening him. No counter-affidavit is filed as on today.
While admitting the writ petition on 26.06.2014, this Court passed the following order:
"So long as the writ petitioner is not involved in any crime and his presence is not required as part of any
investigation into any crime registered with any of the police stations, the writ petitioner shall not be summoned unnecessarily to the police station and made to spend his time for a number of hours unproductively there."
In view of the same, this Writ Petition is disposed of making the interim order dated 26.06.2014 passed in WPMP No.21818 of 2014 as final order. No costs.
