HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1147 OF 2015 ORDER:

This Court in WPMP.No.10026 of 2015 in W.P.No.7572 of 2015 passed order, dated 23-03-2015, that the respondent-Corporation shall take further action in pursuance of the notice issued under Section 452(1) and 461(1) of the Greater Hyderabad Municipal Corporation Act, 1955. Alleging violation of said orders, this contempt case is filed. Counter is filed by the 2nd respondent stating that the 3rd respondent filed I.A.No.249 of 2015 in O.S.No.773 of 2015 pending on the file of City Civil Court, Hyderabad and obtained an order of statusquo. As such, they could not take further action and they have also filed counter before the Court below. As such, they have not committed any violation of the orders passed by this Court.

It is to be seen that though learned counsel for the petitioner sought time for filing reply affidavit, it is not denied that the 3rd respondent filed O.S.No.773 of 2015 and I.A.No.249 of 2015. In view of the same, I do not see any violation of the orders passed by this Court. Accordingly, the Contempt Case is dismissed. However, the respondent-Corporation may take further action after disposal of I.A.No.249 of 2015 in O.S.No.773 of 2015.

As a sequel thereto, miscellaneous petitions, if any, pending in this contempt case, shall stand closed.
