THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.23784 of 2015 ORDER:

The petitioner was appointed as fair price shop dealer of shop No.3 of Bukkapuram Village, Mahanandi Mandal, Kurnool District on permanent basis. The authorization of the petitioner is valid as on today. While so, the Mandal Revenue Inspector of Mahanandi Mandal inspected the shop on 09.04.2015 and submitted a report to the fifth respondent-Tahsildr, Mahanandi Mandal stating that he noticed some variation in the stock of rice. On the same day, the fifth respondent in turn submitted a report to the fourth respondent-Revenue Divisional Officer, Nandyal. Based on which, the authorization of the petitioner was suspended on 30.04.2015 pending enquiry. The petitioner submitted his explanation on 22.06.2015 to the show cause notice issued by the fourth respondent on 18.06.2015. When enquiry was not completed, the present writ petition is filed. The learned counsel for the petitioner submitted that the variations are within the permissible limits and authorization of the petitioner should not have been suspended pending enquiry for the said minor variations.

No doubt, the variations are within the permissible limits but since the order was passed on 30.04.2015 and alternative arrangements have been continuing for the last three months, this Court is not inclined to interfere with the enquiry process at this stage, as it would disturb the alternative arrangements. In the circumstances, the fourth respondent is directed to complete the enquiry and pass final orders thereon by following the principles of natural justice within 30 days from the date of receipt of a copy of this order.

With the above directions, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
