HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.19735 OF 2016 ORDER:

The petitioner prays for the following relief: "..to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent no.3 in not disposing the appeal dt.14-10-2014 filed by the petitioner against the orders passed by the respondent no.4 vide proc. E2/1351/2008 dt.24-6-2014.

cancelling the authorization of the petition in respect of fair price shop no.12 of Ganeshpadu(v) Damaracherla (M) Nalgonda District as illegal, arbitrary, and violative of principles of natural justice and consequently direct the respondent no.3 to dispose of the appeal within a reasonable time.."

Admittedly against the impugned proceeding, on 14.10.2014 appeal was filed before the Joint Collector, Nalgonda/3rd respondent. Learned counsel appearing for petitioner submits that the petitioner is satisfied if the appeal is directed to be considered and disposed of by 3rd respondent as expeditiously as possible preferably within eight weeks from the date of receipt of a copy of this order. On instructions, the Assistant Government Pleader informs this Court that the 3rd respondent will hear and dispose of the appeal within eight weeks from the date of receipt of a copy of this order. The writ petition is disposed of by this order: The petitioner is given liberty to seek for expeditious disposal of appeal by enclosing a copy of this order. The 3rd respondent hears and disposes of the appeal in accordance with law within eight week thereafter. No order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
