HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10358 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondents 1 and 2 to accept the compensation amount of Rs.1,11,946/- i.e., Rs.36,946/- by way of demand draft and Rs.75,000/- by way of fixed deposits made in favour of the respondents 3 to 5.

This Court, vide order dated 30.07.2004 in WPMP No.13149 of 2004, directed the respondents 1 and 2 to accept the compensation amount of Rs.1,11,946/- i.e., Rs.36,946/- by way of demand draft and Rs.75,000/- by way of fixed deposits made in favour of the respondents 3 to 5.

When the matter is taken up for hearing today, learned counsel for the petitioner submits that pursuant to the interim order dated 30.07.2004 granted by this Court, the petitioner had deposited the amount as directed by the respondents 1 and 2 and, hence, the cause in the writ petition does not survive for adjudication and the writ petition becomes infructuous.

Recording the submission made by the learned counsel for the petitioner, the writ petition is dismissed as infructuous.
