THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6470 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A-2, A-5 to A-7, A-9, A-11 and A-12 seeking to quash the proceedings in Crime No.491 of 2015 on the file of I Town Police Station, Karimnagar, Karimnagar District.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioners are punishable under Sections 420, 120-B, 468 and 506 I.P.C., Section 27 of the Indian Arms Act and Sections 3 and 5 of the Andhra Pradesh (Telangana Area) Money Lenders Act.

4. Learned counsel for the petitioners submitted that the petitioners were arrested in several cases and later, released on bail; that the cases were transferred to CID Police Station and they are attending before the CID Police at Karimnagar daily; that the petitioners were in judicial remand for more than 60 days; that even after knowing about the pendency of the present crime, the police have not produced them on PT warrant before the Court concerned for remand and the police are trying to arrest them in the above case.

5. In view of the above submission, the police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioners. In the event of necessity, the police are directed to issue notice to the petitioners for their appearance before the Investigating Agency for the purpose of investigation. On issuance of such notice, the petitioners shall appear before the Investigating Agency and give an undertaking as to their future appearance as and when required by the Investigating Agency for the purpose of investigation.

6. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
