THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.2653 OF 2018 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent No.2 herein not considering petitioner representation bearing application no 03/Reg/58/2372015 dated 23.07.2015 for the grant of assignment under G.O.Ms.No.58 of 2014 as illegal arbitrary and Consequently direct the respondent No.2 herein to grant assignment to petitioner in respect of dwelling unit bearing H no 101611/368 East Maredpally, Secunderabad and pass such other relief or reliefs as this Honble Court deems fit and proper in the circumstances of the case."

Despite the fact that the matter is pending on the file of this Court since 31.01.2018, when notice was ordered to the authorities, no counter affidavit has been filed. The learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that no instructions have been furnished till date.

As the petitioner is only seeking an innocuous relief in the form of a direction to the authorities to take appropriate action upon his application, this Court sees no purpose served in keeping the matter pending. The Writ Petition is accordingly disposed of directing the respondents to take appropriate action upon the petitioner's application dated 23.7.2015 for grant of assignment under G.O.Ms.No.58, dated 30.12.2014, expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending miscellaneous applications, if any, in this Writ Petition shall stand closed.
