HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.2627 of 2018 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Municipal Administration for respondent No.1. Even offer to appear by learned Standing Counsels i.e., Sri P. Govind Reddy for respondent No.2 and Sri S.D. Goud for respondent No.3 recorded and heard on 30.01.2018, there is neither appearance nor representation, hence notice is sufficient from the very offer recorded with no representation. Already this Court passed interim order on 30.01.

2018 from hearing both sides referred supra in saying if at all road widening is to be taken up by the respondents the property of the petitioner and the area to be acquired and the existing structure may be video graphed and photographed by both sides and subject to undertaking to pay compensation as per law to be given by the respondents if the road widening activity in the petitioners private property to be taken up. With these observations, the Writ Petition itself is disposed for nothing more to keep it pending, but for with further direction in the event of such undertaking, the authorities must initiate the proceedings contemplated by Sections 145 & 146 of GHMC Act if the petitioner is willing for arriving of the amount else to initiate proceedings contemplated under Section 147 of GHMC Act.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
