THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2689 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents 1 to 3 and 5.

In view of disposal of present Writ Petition, notice to respondent No.4 is dispensed with.

The petitioner claims that he purchased the land to an extent of Ac.0.32 guntas situated in Survey No.1196/A/10 in the year 2015 from one Indurti Laxminarayana Chary under a registered Sale Deed bearing document No.3796/15. It is the ancestral property of his vendor. The fourth respondent is the absolute owner and possessor of land to an extent of Ac.0.31 guntas in Survey No.1196/A having purchased the same under a registered document No.1348/1998 and his name was also mutated in the revenue records. The land of the fourth respondent and the land of the petitioner are situated adjacent to each other. Taking advantage of the contiguous nature of the land, the fourth respondent appears to have got his name entered in the revenue records and when the petitioner noticed the same, he lodged a complaint with the first respondent on 21.11.2017. When no action was taken by respondents 1 to 3 and on the other hand, the fourth respondent occupied the land of the petitioner, the present Writ Petition is filed.

Learned counsel for the petitioner submits that the main grievance of the petitioner is with regard to entering the name of the fourth respondent in the revenue record as against the land held by

the petitioner. If that is so, it is open to the petitioner to submit an application under Section 3 (3) of the Telangana Rights in Land and Pattadar Passbooks Act.

Granting such liberty, the Writ Petition is disposed of. However, this order will not preclude the petitioner from availing other appropriate civil remedies, if any.
