THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.2649 of 2018 ORDER:

When the matter is taken up for hearing, written instructions dated.23-02-2018 furnished by the Sub-Inspector of Police, Lalapet Police Station, Guntur Urban District are placed on record by the learned Government Pleader for Home. As such, instructions, to the extent of their relevancy, read as under: - "It is submitted that one Gumma Srinivasa Rao, the nephew of the 5th respondent, has approached the 4th respondent police station and made a written complaint dt.21.12.2017, against the neighbouring welding shop of the petitioner herein, alleging that in view of the sound pollution there has been disturbance in night time to his ageold parents and studies of the complainant. Thereon, the 4th respondent police has called both the petitioner and the complainant on 27.12.

2017 to the police station, wherein the petitioner has given undertaking that he will carry out welding operation in his shop, without any excess sound and without causing noise pollution/ disturbance to the neighbours. Accordingly, the matter was closed on 27.12.2017 itself. Thereafter, no further action was taken by the police in this matter. It is submitted that the 4th respondent police have nothing to do with the civil disputes between the owner of premises of the petitioner herein and the 5th respondent herein, which is said to be subject matter of suit in OS No.651/ 2015 on the file of the Hon'ble I Addl.Senior Civil Judge, Guntur and the respondent police authorities has never interfered in the same at any point of time.

It is submitted that the contention of the petitioner that at the instance of the 5th respondent, the 4th respondent authorities has been interfering with the business activities of the petitioner is absolutely false, baseless and hereby specifically denied." On noticing the same, it is requested by the learned counsel for the petitioner to place the said instructions on record. Accordingly, the writ petition is disposed of by placing the above said instructions on record. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
