THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.3092 OF 2020 ORDER:

Heard the learned counsel for the petitioner and Sri Pasham Srinivasulu, learned Standing counsel for ESI Corporation. When the matter is taken up for hearing, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with a liberty to approach Employee State Insurance Corporation Court (ESI Court) under Section 75 of the ESI Act, 1948.

In view of the aforesaid submission, this writ petition is dismissed as withdrawn giving liberty to the petitioner to approach ESI Court. However, the respondents shall not insist for execution of the impugned proceedings, if the petitioner approaches the ESI Court within a period of one month. No order as to costs.
