THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.17513 of 2012 ORDER:

Heard the counsel for the petitioner and the learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage.

The present writ petition is filed questioning the in action of the respondent in conducting fresh enquiry as per the order passed in Roc.No.G/6111/87, dated 1010-1992 as confirmed in V3/273/94 dated 05-05-2001, as illegal and arbitrary and consequently seeking a direction to complete the enquiry in IDT.No.8/83 pending before the Inams Deputy Tahsildar at the earliest.

The facts in issue are as under:

The petitioner's predecessors-in-title filed an application under Section 7(2) of A.P. Inams (Abolition and Conversion in to Ryotwari) Act (for short "the Act") for grant of ryotwari patta to the extent mentioned in T.D.No.2247. The respondent objected the claim of the ryots in IDT No.8/83, dated 10-11-1985. Challenging the same, the petitioner herein filed an appeal before the Revenue Divisional Officer, Tirupathi. The appellate authority set aside the said order and remanded the matter for fresh enquiry and to take necessary action for grant of ryotwari patta to the eligible persons vide proceedings Roc.No.G/611/87,dated10-10-1992. Aggrieved by the said order, one K.S.Ramanujan filed a revision before the Commissioner of Appeals under Section 14-A of the Act.

By an order dated 29-03-2011, the Commissioner of Appeals confirmed the orders passed by the appellate authority. In view of the remand order, the respondent has to conduct denova enquiry and grant ryotwari patta to the eligible ryots. It is stated that though the Commissioner dismissed the revision dated 29-03-2011, till date, the respondent has not passed any orders.

Having regard to the circumstances stated above, the writ petition is disposed of directing the respondent to dispose of IDT.No.8/83, which has been remanded to him pursuant to the orders passed by R.D.O., within a period of six months from the date of receipt of order, in accordance with law. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
