THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.13404 OF 2007 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondent authorities in not permitting the petitioner to discharge her duties as Anganwadi Worker of Gunturpalli Anganwadi Centre, Venkatapur Mandal, Warangal District, though the appointment order was issued by the 2nd respondent on 09.04.2007, as arbitrary and illegal. By way of the interim order dated 28.06.2007 the petitioner was directed to be continued in service. The said interim order was made absolute by order dated 12.02.2008, and the petitioner is said to be continuing in service till date.

Learned Government Pleader for Woman and Child Welfare, appearing on behalf of the respondent, would submit that the petitioner's services were hitherto terminated on the premise that she did not belong to the same village; she has subsequently produced a certificate issued by the Tahsildar that she belongs to the very same village; and the premise, on which her services were terminated earlier, is unfounded. In view of the interim order dated 28.06.2007, and as the petitioner is continuing in service for the past eight and half years, no further orders need be passed in this Writ Petition. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. No costs.
