THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43623 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue an appropriate writ order or direction more in the nature of WRIT OF MANDAMUS declaring the inaction of the 3rd respondent in passing orders in granting permission to the petitioner Institution to run B.Sc.,(N) Course for the academic year 2016-17 though inspection to the petitioner College was conducted on 28-07-2013 and 29-07-2013 and in spite of the 2nd respondent granting permission to run the B.Sc.,(N) Course for the academic year 2016-17 vide proceedings dated 31-10-2016 as illegal, arbitrary, amounting dereliction of duty and consequently direct the 3rd respondent to pass orders in granting permission to the petitioner College pursuant to the inspection conducted by the Committee of the 3rd respondent dated 28-07-2013 and 29-07-2013 forthwith" 2.

Heard and perused the material available on record. 3.

Case of the petitioner college is that respondent No.3 issued a show cause notice on 21.1.2015 informing as to why action should not be initiated to cancel the recognition of the institution in view of violation of certain norms for which, the petitioner college has given an explanation on 27.2.2015, but even after receipt of the explanation from the petitioner college, respondent No.3 has not passed any order till date resulting in causing prejudice to the petitioner college and it could not admit the students in the college.

Considering the facts and circumstances of the case and the grievance of the petitioner college, this writ petition is disposed of with the following direction:

Respondent No.3 is directed to pass appropriate orders on the explanation, dated 27.2.2015, of the petitioner in accordance with law within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
