THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31369 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner states that she is a physically handicapped person and she was appointed as a fair price shop dealer of shop No.61, Julakallu Village, Piduguralla Mandal, Guntur District. The authorization of the petitioner is valid upto 31.03.2016. On 13.06.2015, the sixth respondent along with other officials inspected the shop of the petitioner and found some variation in the stock. Subsequently, 6-A proceedings were initiated and they are pending before the third respondent. While so, the fourth respondent issued a show cause notice on 20.06.2015 in respect of the variation in the stock and the petitioner submitted her explanation on 25.06.2015. After receiving the explanation, the fourth respondent passed an order on 27.07.2015 suspending the authorization of the petitioner. Challenging the same, the present writ petition is filed.

After careful perusal of the show cause notice and the explanation offered by the petitioner, this Court prima facie feels that the order of the fourth respondent dated 27.07.2015 does not warrant interference at this stage. However, the fourth respondent is directed to conduct an enquiry in respect of the allegations leveled against the petitioner and pass final orders thereon, within a period of 30 days from the date of receipt of a copy of this order, by giving due opportunity to the petitioner.

4. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any pending, shall stand closed. ______________________________ A.RAMALINGESWARA RAO, J Date: 28.09.2015
