CRIMINAL PETITION NO. 6353 OF 2011 O R D E R :
The petitioners are A-1 to A-4 in Crime No. 24 of 2011 registered by Station House Officer, Kadiyam Police Station, East Godavari district, for the alleged offence punishable under section 3 (1) (x) of SC/ST [POA] Act and under section 323 of IPC.
2. The second respondent is the defacto complainant.
3. Heard both sides.
4. Specific allegations were made against the petitioners in the complaint. This is a matter which requires investigation by the police. The truth or other wise of the allegations can only be decided during the course of investigation or trial. I see no grounds to interdict the investigation at this stage and quash the First Information Report.
6. In the facts and circumstances of the case, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, shall not arrest the petitioners/A-1 to A-4 till the
investigation is completed and charge sheet is filed. The petitioners shall appear before the investigating agency as and when required and co-operate with the investigation.
7. Pending miscellaneous applications, if any, shall stand closed in consequence.
